Terms and conditions

These terms cover buying from Driveway. Placing an order means you accept them.

Orders

An order is an offer to buy. The contract forms when we email you to confirm the item has shipped, not when you click the button. If we cannot fulfil an order we will tell you and refund you in full.

Prices and payment

Prices are in US dollars and are shown before tax. Payment is taken when the order is placed. If a price is listed incorrectly we will contact you before charging, and you can cancel without penalty.

Freight

Palletised items carry a flat $150 freight charge per order. It is charged once regardless of quantity and is not refundable, including when the item itself is returned, because the cost of delivering the pallet has already been incurred.

Delivery

Delivery estimates are estimates. Pallet freight is kerbside; the carrier is not obliged to move the item onto your property. Inspect the pallet before signing, and report damage within 48 hours with photographs.

Returns

You have 30 days from delivery. The item must be unridden and in its original packaging. Return shipping is yours to arrange and pay for unless the item was faulty or wrongly supplied.

Intended use

Every powered ride-on we sell is a ride-on toy, certified under ASTM F963. None is a registered vehicle and none is road legal. They are for private property, within their stated age range, under adult supervision. Using one outside those limits is at your own risk and voids the warranty.

Warranty

Twelve months against manufacturing defects, from the date of delivery. Batteries are consumable and are covered for six months. Wear, misuse, modification and crash damage are not covered.

Liability

Nothing here limits our liability for death or personal injury caused by our negligence, or for anything else that cannot lawfully be limited. Otherwise our liability is limited to the amount you paid for the item.

Law

These terms are governed by the law of the State of California, and its courts have jurisdiction.
